To apply for a lasting power of attorney (LPA) you must make one whilst you’re still able to make decisions for yourself. You must also 18 or over. The person you choose to look after your affairs should be chosen carefully. The person you choose is called an attorney.

A lasting power of attorney is a legal document that lets you appoint one (sometimes more) people to help you make decisions, or make decisions on your behalf. A LPA gives you more control over what happens to you should you have an accident or illness where you can’t make decisions at the time they need to be made.

There are two types of LPA, these are:

  • health and welfare
  • property and financial affairs

A lasting power of attorney regarding health and welfare.

This gives your attorney the power to make decisions about:

  • daily routine
  • medical care
  • life-sustaining treatment
  • moving to a care home

A lasting power of attorney regarding Property and financial affairs.

This gives your attorney the power to make decisions such as:

  • managing bank/building society accounts
  • paying bills
  • collecting pension and benefits
  • selling your property

The process to make a lasting power of attorney

  1. Choose your attorney – you can have more than one
  2. Fill in the correct form (from the governments website) found here
  3. Register your LPA with the Office of the Public Guardian – £110 registration fee*
