Lasting Powers Of Attorney In LondonWhy Is It Important To Have A Lasting Power Of Attorney In London?

Unfortunately, in life we never know what is waiting for us around the corner but by appointing a Lasting Power of Attorney in London, it will allow you to appoint a person (attorney) to take care of any finances that you have when you can’t personally handle them for yourself.

The Two Types Of Lasting Power Of Attorney (LPA)

There are two types of LPA’s, the first being the Health and Welfare LPA and the second being the Property and Financial Affairs LPA.

Health and Welfare LPA

You would use the Health and Welfare LPA if you are wanting the attorney to make decisions relating to:

  • Medical care
  • Movement into a care home
  • Life-sustaining treatment

The Health and Welfare LPA can only be enforced if the person can’t make the decision on their own.

Property and Financial Affairs LPA

You would use a Property and Financial Affairs LPA if you wanted to give an attorney the power to make decisions relating to:

  • Managing a bank account
  • Paying bills
  • Collecting benefits or a pension
  • Selling a property

The Property and Financial Affairs LPA can be used as soon as it’s registered, with the persons permission.

Registering A Lasting Power Of Attorney In London

A Lasting Power of Attorney cannot be used until it is registered with the Office of the Public Guardian. You will also need to be over the age of 18 and you must have the ‘mental capacity’ at the time when the LPA is being made.

You do have the option to have both the Health and Welfare LPA and the Property and Financial Affairs LPA, but they will both need to be registered separately.

It costs £82 to register each LPA unless you get a reduction or exemption. If you were to get both types of LPA, it will cost you £164.

If no mistakes are found in the application, it can take up to 10 weeks to register an LPA.
